Advice to Government Consultation on Proposals to Criminalise Sexually Explicit Deepfake Images

NICCY welcomes the Department of Justice (the Department) consultation on Proposals to Criminalise Sexually Explicit Deepfake Images.

We wish to emphasise the importance of taking a child rights approach in ensuring all online service providers meet their responsibility in respecting the rights of the child in the digital environment and encourage them to support and promote these rights. There are a number of key UNCRC Articles relating to this consultation that should be considered, as follows:

  • Article 3: Best interests of the child;
  • Article 6: Life, survival and development;
  • Article 9: Non-discrimination;
  • Article 16: Protection of privacy;
  • Article 17: Access to information;
  • Article 19: Protection from violence;
  • Articles 28 and 28: Access to, and the aims of, education;
  • Articles 34 and 26: Protection from abuse and exploitation; and
  • Article 40: Children who break the law.
