In accordance with Article 24 of the UNCRC, every child has the right to the highest attainable standard of health, including accessing and using appropriate support and treatment within the emotional health, wellbeing, and mental health context.
NICCY must express both its disappointment and concern that there is no clear and explicit reference to the UNCRC generally or the Article 24 relating to the child’s right to health specifically within the Emotional Health and Wellbeing Framework. NICCY is further concerned that the Framework does not demonstrate any specific understanding as to the application of the right to health within the context of emotional health, wellbeing, and mental health of children and young people, including within delivery of public services, and the subsequent responsibilities upon the government and relevant statutory authorities and agencies to recognise, protect, and promote the child’s right to health.
